編按：本文緣起於6月5日自由時報一篇關於彰化某國中歷史科考題的爭議，詳見以下所附連結。 作者：吳宗謀（中央研究院法律學研究所助研究員）. 問題其實出在第1題，而不是第2題。第2題的答案並沒有足夠的證據來支持。 目前看起來命題者認為戒嚴時期組織政黨違反戒嚴令。這個答案是錯誤的。目前人們已經知道1949年5月19日公布的臺灣省政府暨臺灣省警備總司令部佈告戒字第1號的臺灣省戒嚴令未經總統（李宗仁）公布，也未經立法院同意。在此可暫時不討論這個問題，並假定戒嚴令的法定程序已經完成。即便如此，規範上可以認為臺灣省戒嚴令未禁止組織政黨與政黨的室內集會。 由於戒嚴令並未禁止結社，中華民國政權中已存在的青年、民社兩黨在臺灣可以繼續活動，甚至招收新黨員。而雷震籌組中國民主黨時，中國國民黨的反應是奇怪的「不承認」，而不是「違法」。雖然籌組政黨是引起雷震遭到逮捕的原因之一，但如果是違反戒嚴令這麼簡單的理由，一瞬間就可以獲得形式理由來打擊Ӎ...不過這個規定後來漸漸被淡忘。1958年3月25日，當時的立委夏濤聲（青年黨）質詢行政院長俞鴻鈞時表示：&#...中華民國政權中的政黨都是在尚無法律規定時就已組成。...

作者：郭詠華（西雅圖華盛頓大學法學院博士生）. 在最近一則嘉義市戶政檔案資料展的相關報導中，新公開的史料揭露了當初陳澄波的戶籍資料記載其死因為「變死」。最開始的新聞報導中，「變死」被誤解釋為台語的「砰死」，後來才更正「變死」其實是日語的「非自然死亡」之意。這顯示出台灣的社會生活中——包含法制度與法律實踐在內——其實潛藏著許多未被發現或是被誤解的日本因素。 現在的台灣社會存在著一套非常縝密的戶籍制度，戶籍資料記載了每個人的出生、親屬關係異動、死亡等多項法律關係，而國民身分證字號與國民身分證更是國家確實掌握與分辨每一個特定人士身分資料的其中一環。雖然歷經多次變革，不過原則上現代台灣的戶籍制度可說是奠基於日治時期的戶口制度及其資料。相較於傳統清帝國以徵稅和維持治安為目的，僅收集部分且不夠精確的台灣人口資料，從1895年開始統治台灣的日本帝國及其轄下的台灣總督府，為了清楚了解與確實掌控台灣社會的具體人口情狀，從統治初期就著手清查台灣人民的家庭與個人狀況A...在國家法規與警察強力執行的情況下，日治時期台灣的戶口法規得以落實在台灣社會中，戶口調查簿所登載的資料也有相當程度的正確性...紙本資料的保存以及人們...
